The Petitioners seek bail in Saharsa Sadar P.S. Case No. 7 of 2017 registered for the offence punishable under Sections 147, 148, 149, 341, 342, 323, 307, 353, 224, 225, 188, 333, 336, 395, 504, 506 of the Indian Penal Code. Allegation against the petitioners are that they obstructed the police in performing their duty of arresting Subhak Ram at the instance of said Subhak Ram and other accused persons prevented the police to arrest him, and also assaulted the police party as well as snatched away one Rifle and 25 cartridges of the police. The police party also sustained injuries in the said incident. There is general and omnibus

Patna High Court Cr.Misc. No.57973 of 2017(3) dt.11-01-2018 2/2 allegation against all the accused persons in the FIR and no specific overt act has been alleged against the petitioner. The petitioners have got no criminal antecedent and petitioner no. 1 is in custody since, 11.09.2017 and petitioner nos. 2 and 3 are in custody since, 28.08.2017. Similarly situated co-accused persons have been granted bail by a co-ordinate bench of this Court vide orders dated 13.07.2017 in Criminal Miscellaneous No. 31614 of 2017 and dated 28.03.2017 in Criminal Miscellaneous No. 12054 of 2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saharsa, in connection with Saharsa Sadar P.S. Case No. 7 of 2017.
