The petitioner is accused in Bhagwanpur Police Station Case No 110 of 2007 registered for the offences punishable under Sections 302, 201/34 of Indian Penal Code and Sections 25/26 of Arms Act.

Counsel for the petitioner submits that the first information report has been lodged by the Chaukidar against unknown persons. It is further submitted that the petitioner has only been implicated in this case because, during course of investigation, it has been alleged that the deceased had accompanied the petitioner few days earlier going to a temple and merely on the basis of suspicion, he is in custody since

Patna High Court Cr.Misc. No.55375 of 2017 (3) dt.12-12-2017 2/2 16.08.2017. It is also submitted that there is no criminal antecedent against the petitioner and the investigation in the case is complete and charge sheet has been submitted. Considering the aforesaid submission, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I, Kaimur at Bhabhua in Bhagwanpur Police Station Case No 110 of 2007 subject to the following conditions :

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
