JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 395 and 397 of the Indian Penal Code. According to the fardbeyan of the informant that the accused persons have robbed the truck of the informant bearing Registration No. BR-OIGC-5140 along with mobile phone on the point of pistols and also injured the informant as well as Khalasi of the truck. Accused persons also administering stupefying drug with intent to cause hurt to the informant and Khalasi. It is submitted on behalf of the petitioner that the petitioner is in custody since 23.02.201.The petitioner has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the

His name has come in course of investigation.The mobile, which is alleged to have been looted in course of occurrence, SIM card of the said mobile is said to have been used by the petitioner. The petitioner has not been put on T.I. parade to ascertain the implication of the petitioner.

On behalf of the State it is submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Danapur (Patna) in connection with Dulhin Bazar P.S.Case No. 25 of 2016.
