====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 25-10-2021 Heard learned counsel for the petitioner and learned APP for the State. Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

The petitioner apprehend his arrest for the offences alleged under Sections 302, 201, 34 IPC, registered in connection with Lalganj P.S. Case No. 93 of 2013. The informant has filed a complaint case alleging therein that the father of this petitioner persuaded the father of the deceased to go and work with this petitioner for Rs. 4000/- per month.

Learned counsel for the petitioner has submitted that co-accused Bindeshwar Paswan has been granted regular bail by

Patna High Court CR. MISC. No.28779 of 2021(2) dt.25-10-2021 2/2 learned coordinate Bench of this Court in Cr. Misc. No. 49684 of 2015 vide order dated 30.1.2016.

From perusal of the record, it appears that anticipatory bail petition of this petitioner was rejected by this Court, vide order dated 13.10.2015 in Cr. Misc. No. 31270 of 2015. Thereafter, after a lapse of six years, the petitioner did not surrender before the learned court below and the trial hampered for a pretty long period due to non-surrender of the present petitioner.

In the above-mentioned facts and circumstances, I do not think it a fit case for anticipatory bail. The petitioner is directed to surrender before the court below and pray for regular bail.

Office shall ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
