====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 07-04-2026 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 115(2), 118, 303(2), 109, 352 and 351(2) of the BNS.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on 03.12.2025, he has gone on his land when accused persons including the petitioners came and started claiming the land as their, on objection, Sanoj (petitioner no. 1)
Patna High Court CR. MISC. No.19194 of 2026(2) dt.07-04-2026 2/3 assaulted him by kudal causing injury on head and Randhir dashed him on the ground and when his brother Rajesh and Muntun came to save him, when all the accused assaulted them and Vikash took out Rs.5,000/- from the informant.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant, it is next submitted that from perusal of the allegation as alleged in the FIR it would manifest that on account of dispute relating to land, the occurrence is alleged to have taken place, it is also submitted that side of the informant has also assaulted the side of the petitioner and Sanoj suffered two injuries on head which have been opined to be grievous by the doctor. It is fairly submitted that in the instant FIR, it is alleged that Sanoj assaulted the informant by kudal causing injury on head but then no specific allegation is alleged against petitioner nos. 2 and the allegation against petitioner no. 3 is exaggerated.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners and submits that petitioner no. 1 is alleged to have assaulted the informant by kudal causing injury on head and the same has been opined to be grievous in nature. It is also submitted that no doubt it has been submitted
Patna High Court CR. MISC. No.19194 of 2026(2) dt.07-04-2026 3/3 that even Sanoj suffered two grievous injuries on head but then that in itself cannot be a ground for granting the privilege of anticipatory bail to Sanoj.

Considering the submissions made by the learned counsel for the parties, the petitioner nos. 2 and 3, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bhagwanpur P.S. Case No. 364 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. The court is not inclined to extend the privilege of anticipatory bail to petitioner no. 1, namely, Sanoj Kumar Singh. (Satyavrat Verma, J) Gaurav Sinha/- U T
