Petitioner seeks bail in Kuchaikote P.S. Case No.105 of 2018 instituted for the offence under Section(s) 22 and 22 of the NDPS Act.

It has been submitted that petitioner earlier moved for regular bail vide Cr. Misc. No.28683 of 2018, which was rejected by order dated 14.05.2018 with observation to renew the prayer for bail after framing of Charge. Charge has been framed on 01.08.2018.

Allegation against the petitioner is that 500 Gr. Ganja kept in a plastic bag and 20 small bags of Ganja each of 2 gm (total 540 gr.) were recovered from the betel shop of the

Patna High Court Cr.Misc. No.55529 of 2018 (2) dt.20-09-2018 2/2 petitioner. Petitioner is said to be in custody since 14.04.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Gopalganj, in connection with Kuchaikote P.S. Case No.105 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
