Petitioner, already in custody, seeks bail in connection with Sikrahta P.S. Case No.12 of 2017, giving rise to Sessions Case No.243 of 2017, registered under Sections 147/148/149/302 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that one Lakhpato Devi gave a bhujali blow over the head of the deceased and this petitioner also gave an axe blow over the head.

Learned counsel for the petitioner submits that similarly situated co-accused Sharda Devi has been admitted to bail by a coordinate Bench of this Court by order dated 15.11.2017, passed in Cr. Misc. No.52862 of 2017.

Patna High Court Cr.Misc. No.4079 of 2018(3) dt.20-02-2018 2/2 However, learned counsel for the State submits that the specific allegation is against the petitioner of giving axe blow over the head of the deceased and corresponding injury is found on the deceased.

Having considered the said facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Sikrahta P.S. Case No.12 of 2017, giving rise to Sessions Case No.243 of 2017, pending in the court of learned 6th Additional Sessions Judge, Bhojpur (Ara).
