The petitioner seeks bail in connection with Goraul P.S. Case No. 54/2014 instituted for the offences under Section 395 of the Indian Penal Code.

From bare perusal of the allegation as alleged in the FIR, it would manifest that the informant on 24.02.2014 at NH 77 near Godiya Bridge, his new Bolero vehicle was intercepted by three miscreants on a motorcycle. These miscreants over powered the informant on gun point and pushed him on the middle seat. All these miscreants took away the said vehicle and they dropped the informant near Mahua turning. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.28593 of 2021(2) dt.23-11-2021 2/2 case. The petitioner is not named in the FIR and on the basis of confessional statement of co-accused, he has been made accused in this case. The petitioner is apprehended in this case on 02.11.2020 and charge sheet has been submitted in this case. The petitioner has got two criminal antecedents, which is mentioned in para 3 of the bail petition.

Learned APP for the State vehemently opposes the prayer for bail application.

Considering the facts aforesaid, the petitioner, above named, is directed to be released on bail on his furnishing bailbonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Vaishali at Hajipur in connection with Goraul P.S. Case No.54/2014.
