JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The petitioners, who are persons of clean antecedents and are in custody since 06.02.2020, seek bail in connection with Complaint Case No. C-2/97 of 2020 dated 06.02.2020 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
It appears from the impugned order that 450 litres of Nepali liquor was recovered from their possession.
The petitioners claim that they have been
Patna High Court CR. MISC. No.16544 of 2020(2) dt.13-05-2020 2/2 arrested on mistaken identity. The illicit liquor, it has been urged, was recovered from near a pillar at the border of the State of Bihar with Nepal and the petitioners have only been arrested on suspicion. Regard being had to the nature of recovery / accusation against the petitioners and their period of custody, they are directed to be the petitioners, abovenamed, are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned ADJ II cum Special Judge, Excise Act, Sitamarhi in connection with Complaint Case No. C-2/97 of 2020.
