JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 489(KH) of the Indian Penal Code.

Petitioner gave counterfeit note of rupees one hundred to informant for purchasing biscuit but informant doubted about the genuineness of aforesaid note and after that villagers came there and six more counterfeit notes denomination of rupees one hundred each were recovered from conscious possession of the petitioner.

Submission on behalf of the petitioner is that nothing was recovered from conscious possession of the petitioner and as a

Considering the period of detention of the petitioner in jail custody as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Manoj Kumar, Judicial Magistrate 1st Class, Siwan in connection with Gorea Kothi P.S. Case No. 36 of 2016.
