JUSTICE SANJAY PRIYA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Hilsa P.S. Case No. 315 of 2018 (G.R. No. 2346 of 2018, Trial No. 03 of 2018) instituted for the offence under Sections 8/20 (b)(II)(B) and 29 of NDPS Act.

Counsel for the petitioner submits that petitioner has clean antecedent. It is alleged that 2 Kg 500 grams Ganja has been recovered from the room of the house of the petitioner. Counsel for the petitioner further submits that recovered Ganja does not come under the category of commercial quantity. Petitioner is said to be in custody since 18.6.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

No.59837 of 2018 (2) dt.06-10-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cumSpecial Judge, Nalanda at Biharsharif, in connection with Hilsa P.S. Case No. 315 of 2018 (G.R. No. 2346 of 2018, Trial No. 03 of 2018), subject to the condition that both the bailors will be the close relatives of the petitioner.
