JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-25(1-b)A, 25(1-A), 25(1AA), 2(1-AC), 26(i)(ii), (iii) of the Arms Act.

A mini gun factory was unearthed and semi-finished fire-arms and other apparatus, which are used in preparation of fire-arms were recovered. The petitioner and 7 others were caught on the spot but nothing was recovered from conscious possession of the petitioner. Moreover, having similar allegation, co-accused Md. Rinku and Md. Babar have already been granted privilege of bail by this court.

Taking note of the above-said facts and circumstances

Patna High Court Cr.Misc. No.26051 of 2016 (2) dt.24-06-2016 2/2 of the case as well as this aspect of the matter that the petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Muffasil P.S. Case No. 242 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Munger.
