2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.
3 . It is alleged that 1506.240 liter of foreign liquor was recovered from was recovered Mango orchard and a Wagon R Car was also seized from Orchard.
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . Petitioner is owner of the alleged vehicle which was seized on the spot. No incriminating material has been recovered from seized vehicle and as such petitioner is no way

5 . Learned counsel for the State opposes the bail petition .
6. Considering the facts of the case, in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the special Judge - I (Excise Act ), Darbhanga in connection with Bahadurpur ( Fekla OP) Police Station Case No. 163 of 2023 , subject to the conditions laid down under section 438 ( 2 ) of Code of Criminal Procedure .
