The petitioners seek regular bail in connection with Rajgir P.S. Case No. 187 of 2017 instituted for the offences under sections 30(a) and 38(1) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 391 litres of illicit Jharkhand made liquor from the pick up van.

It is alleged that the driver has fled away. However, a mobile was recovered and on the said mobile the petitioners herein were ringing continuously, hence the petitioners herein have been made accused in the present case.

The learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.63201 of 2017 (2) dt.17-01-2018 2/2 merely on suspicion the petitioners have been roped in the present case. No recovery has been effected from the person of the petitioners and they have a clean antecedent and are in custody since 24.11.2017.

Considering the nature of accusation, the period of custody already undergone and the fact that the petitioners are having a clean antecedent, I deem it fit and proper to enlarge the petitioners above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cum-Special Judge, Excise, Nalanda at Bihar Sharif in connection with Rajgir P.S.
