JUSTICE RAKESH KUMAR ORAL ORDER 12-07-2016 Heard Sri Bimlesh Kumar Pandey, learned counsel for the petitioner and Sri Mritunjay Kumar Nirala, learned A.P.P. The petitioner, who is in custody in connection with Manpur P.S. Case No. 16 of 2016 registered for the offence under section 47(a) of the Excise Act, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that on false allegation recovery of 12 liters country made liquor was shown and petitioner has been taken into custody. The petitioner is having clean antecedent, which fact has been stated in paragraph no. 3 of the petition.

Sri Nirala has opposed the prayer for bail. He submits

Patna High Court Cr.Misc. No.26790 of 2016 (2) dt.12-07-2016 2/2 that offence is serious in nature.

Keeping in view the nature of accusation, let the petitioner Ram Pravesh Urao be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of A.C.J.M.-V, Bettiah, West Champaran in connection with Manpur P.S. Case No. 16 of 2016.
