JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The petitioners, who are persons of clean antecedents, seeks bail in connection with Case No. C2/85/20, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It appears from the records that they were intercepted at the border of Bihar and were found to be in possession of 54 litres of Nepali liquor.

The petitioners claim their implications to be on the basis of mistaken identity.

The petitioners are in custody since

Patna High Court CR. MISC. No.16536 of 2020(2) dt.13-05-2020 2/2 03.02.2020.

Regard being had to the nature of accusation and their period of custody as also their clean antecedents, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned ADJ II cum Special Judge, Excise Act, Sitamarhi in connection with Case No. C2/85/20.
