In this regard reference may be made in the case of Jogendrasinhji Vijaysinghji Vs. State of Gujarat and others since reported in (2015) 9 SCC 1 = 2015 (3) PLJR 453 (SC).

Accordingly, this Letters Patent Appeal stands dismissed.
