JUSTICE VIKASH JAIN ORAL JUDGMENT Date : 30-11-2021 Heard learned counsel for the petitioners and learned counsel for the respondents. Learned counsel for the petitioners hereby undertakes to remove all defects pointed out by the Stamp

3/4 Reporter as and when required. It is accordingly directed that all defects pointed out by the Stamp Reporter be removed within one month hereof.

The present writ petition has been filed for the following reliefs as formulated by the petitioner- "(I) To direct the concerned Respondents to help/cooperate the petitioners from private respondents to vacate the lands of Plot No. 2233, 2303, 2404 etc., Tauzi No. 10.6, 107, 108 etc., Thana No. 507, MauzaLodipur, P.S. Chabilapur, District- Nalanda which the private respondents are disturbing from doing the Agriculture work to the petitioners forthwith. (II) To direct the concerned respondents to dispose of the representation filed by the petitioners on 16.01.2020 before the District Magistrate, Nalanda forthwith. (III) To restrain the private respondents not to disturb the petitioners and their family.

(ii) To grant any other relief/reliefs which the petitioners are entitled in the facts and circumstances of the case."

3. Learned counsel for the petitioners appears and presses only relief no. II for disposal of their representation and submits that the remaining reliefs need not be pressed. He invites reference to the said representation filed on 16.01.2020 as

4/4 contained in Annexure-2. It will suffice if a direction for disposal of the application be issued without entering into the detailed merits of the matter.

4. Learned counsel for the respondents appears and has been heard.

5. Having regard to the nature of the grievance of the petitioners, the writ petition is disposed of with a direction to the District Magistrate, Nalanda at Biharsharif (respondent no. 2) to consider and dispose of the representation of the petitioners, said to have been filed on 16.01.2020, if still pending, on its own merits in accordance with law and after grant of an opportunity of hearing to the petitioner, expeditiously and in any event preferably within a period of three months from the date of receipt/production of a copy of this judgment.

6. Office shall follow-up to ensure that all defects are removed and compliance with the notices of this Court are made by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
