JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-10-2020 Heard learned counsel for the appellant as well as learned counsel for the State through video conferencing. The present appeal is directed against the order dated 27.02.2020, passed by learned Addl. District and Sessions Judge 1st, -cum- Special Judge (SC/ST), Nawada in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 504 of the Indian Penal Code and 3(i) (r) (s) SC/ST Act, whereby anticipatory bail of the appellant has been rejected.

There is case and counter case. Allegation of commission of abuse and assault is general and omnibus against the appellant and others. Specific allegation is against coaccused Manoj Yadav to have caused injury with Gandasa at the head of Mithu Paswan and allegation against co-accused Sanjay

Patna High Court CR. APP (SJ) No.1175 of 2020(2) dt.05-10-2020 2/2 Yadav is of commission of injury with iron rod at the head of the informant. The doctor has found head injury on the person of the injured, though simple in nature. Appellant has got no criminal antecedent.

Accordingly, in the event of arrest or surrender by the appellant, above named, before the court below within six weeks from today, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge Ist-cum-Special Judge (SC/ST Act), Nawada in Akbarpur P.S. Case No. 52 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
