28-09-2018 Heard Sri Sandip Kumar Gautam, learned counsel for the petitioners and Sri Chandrasen Prasad Singh, learned Addl. Public Prosecutor.
Two petitioners, who are mother-in-law and father-inlaw respectively of the complainant, apprehending their arrest in Complaint Case No. 1253 of 2017 registered for offence under Sections 498(A), 494, 313, 34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act, 1961, have prayed for grant of bail in the event of their arrest or surrender. Learned counsel for the petitioners, at the very outset, has drawn my attention to statement of the complainant
Patna High Court Cr.Misc. No.60279 of 2018(2) dt.28-09-2018 2/2 recorded on oath during inquiry and submits that complainant herself had said that she does not want to live with her husband. Be that as it may, considering the fact that petitioners are mother-in-law and father-in-law of the complainant, in the event of arrest or surrender within a period of six weeks from today, let aforesaid two petitioners namely Heera Devi @ Teera Devi and Yugal Jha @ Jugal Jha be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Begusarai in connection with Complaint Case No. 1253 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
