This is a case registered under Sections 147,148,341,307,323 and 504 of the Indian Penal Code. A quarrel has ensued between the accused persons who are neighbours as a result thereof, it is alleged that the petitioner has given a 'gandasa' blow on the forehead of the informant's daughter.
Counsel for the petitioner submits the allegations made in the FIR are false. He has drawn the attention of the Court towards the injury report and relying on the same has submitted that the injuries are simple in nature. The petitioner is in jail custody since 9.9.2017. The order dated 17.10.2017 rejecting his prayer for bail passed by the Additional Sessions Judge II,
Patna High Court Cr.Misc. No.55789 of 2017 (2) dt.12-12-2017 2/2 Jehanabad granted him liberty to renew his prayer after two months which is also just lapsed. It is also submitted that the petitioner is a man of clean antecedent.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Jehanabad in Makhdumpur P.S. Case No. 83 of 2017 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.
