The petitioner seeks regular bail in connection with Danapur PS case no. 165 of 2018 registered for the offence punishable under Sections 414 of Indian Penal Code and 25(1-B)A/ 26/35 of Arms Act.

The allegation is regarding three miscreants having been caught by the police and some arms were also recovered. Upon interrogation, they disclosed that the person who had fled away was the petitioner, whereafter subsequently, the petitioner was arrested.

The learned counsel for the petitioner submits that no recovery of any sort of illicit arms has been made from the possession of the petitioner and the petitioner has been

Patna High Court CR. MISC. No.19058 of 2019(2) dt.04-04-2019 2/2 falsely implicated in the present case. It is further submitted that the petitioner is accused in two other cases but he is on bail in the said cases. The petitioner is said to be languishing in custody since 05.06.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I Danapur, Patna in connection with Danapur PS case no. 165 of 2018.
