This is a petition for grant of anticipatory bail for offence under Sections 341, 323, 324, 307, 504 and 34 of the Penal Code.
There is allegation of assault by the petitioners, but, injury found to be simple. It is submitted that though the allegation of assault by hasuli, but, the wound on the skull has been found to be lacerated by hard and blunt substance. Hence, having regard to the facts and circumstances of the case, the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, are directed to be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with the Darauli P.S. Case No. 48 of 2014 to the satisfaction of the Chief Judicial Magistrate, Siwan, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code subject to the
Patna High Court Cr.Misc. No.31414 of 2014 (3) dt.21-01-2015 2/2 condition that the petitioners shall not indulge in such activity further and if the indulge, then, the deponent must inform the Court about the indulgence of the petitioner(s) and the Court below, itself, shall proceed to cancel the bail bond of the petitioner(s).
