2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 140 (2) of the BNS, 2023 and Subsequently, Sections 61 (2), 103 (1), 238 and 3 (5) of the BNS was added.
3. The case of the prosecution, in brief, is that the son of the informant had gone to fetch vegetables with one Guddu Paswan. When he did not return for a considerable moment, a phone call was received on the mobile phone of Guddu Paswan from an unknown person requesting him to connect the call with the informant. Upon speaking to his son, the informant was allegedly told to arrange a sum of Rs. 5 lakhs. Soon, thereafter, the call got disconnected. On being inquired,

No.17975 of 2026(2) dt.18-03-2026 2/3 Guddu Paswan disclosed that the son of the informant (deceased) had broaded a vehicle at Smart point along with one Bhola Mahato and had gone somewhere. Subsequently, when the informant again contacted his son, the deceased allegedly stated that he was being assaulted and asked the informant to come with Rs. 5 lakhs.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that name of the petitioner has surfaced on the basis of the confessional statement of co-accused, namely, Abhinav Kumar. Save and except the confessional statement of co-accused, Abhinav Kumar there is nothing against the petitioner to implicate him. Moreover, the petitioner is languishing in judicial custody since 25.11.2025.
5. Learned APP appearing for the state has opposed the prayer of regular bail stating that the petitioner has seven criminal antecedents.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Lohiyanagar P.S. Case No. 93 of 2025
Patna High Court CR. MISC. No.17975 of 2026(2) dt.18-03-2026 3/3 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai.
7. However, it has been brought on record that the petitioner has criminal antecedents in 7 cases. In such circumstances, he is directed to cooperate in the trial, remain physically present on each and every date fixed by the court, and mark his attendance once every week at Tegra Police Station.
