The petitioner seeks bail in connection with Barh P.S. Case No. 260 of 2017 dated 08.09.2017 instituted for the offences under Sections 302 and 120B/34 of the Indian Penal Code read with Section 27 of the Arms Act.
An under trial prisoner is the informant of the present case. He has alleged that while he along with Guddu Singh were alighting from the vehicle for being produced before the court, firing was resorted to by accused persons. He and Guddu Singh, both were hit by the firing. Guddu Singh (deceased) while falling down on the ground disclosed that Sonu and Monu have committed the murder.
Patna High Court Cr.Misc. No.1311 of 2018 (2) dt.11-01-2018 Learned counsel for the petitioner has submitted that the petitioner is the father of aforesaid Sonu and Monu. Apart from the relationship of the petitioner with the aforesaid two assailants, there is no other material to connect the petitioner with the crime. It has also been submitted that the petitioner is a practicing advocate and is a respectable person of the society. The petitioner is in custody since 24.09.2017. In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Barh P.S. Case No. 260 of 2017.
