JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-03-2019 Earlier application of the petitioner for grant of anticipatory bail was disposed of by this Court vide order dated 2.7.2018 passed in Cr.Misc.No. 25868 of 2018 with direction to the petitioner to surrender within a period of eight weeks from the receipt of that order along with a Bank Draft for Rs.12 lakh in favour of Sitamarhi Central Co-operative Bank and once the same was deposited, learned court below would release him on bail to its own satisfaction.
Now the present application has been filed for modification of the said order on the ground that money could not be arranged and as such he could not surrender and it is submitted that now money has been arranged after much effort
Patna High Court CR. MISC. No.17111 of 2019(2) dt.27-03-2019 2/2 and he is ready to deposit the same and as such the period for surrender may be extended.
Heard learned APP also.
In the facts and circumstances, I am not inclined to interfere with the earlier order dated 2.7.2018. However, if the petitioner so surrenders before the court below and is ready to deposit the amount of Rs.12 lakh by way of a Bank Draft in favour of Sitamarhi Central Co-operative Bank, the same shall be considered by the court below and his application for bail shall be disposed of, if possible, on the same day. With the above observation, this application is disposed of.
