The petitioners being parents of the husband of the complainant are apprehending their arrest in complaint case registered for the offences punishable under Sections 498 (A) of the Indian Penal Code and under Section 4 of Dowry Prohibition Act.

The basic accusation is of torture for non fulfillment of dowry demand.

It is submitted by the learned counsel for the petitioners that the accusation against petitioners is omnibus and general and the petitioners are living separately from husband of

Patna High Court Cr.Misc. No.38630 of 2014 (2) dt.10-02-2015 2/2 the complainant.

Considering the thrust of accusation against the husband of the complainant, let the petitioners above named be released on provisional anticipatory bail for one year in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 851C of 2013 to the satisfaction of learned Sub Divisional Judicial Magistrate, Khagaria, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
