1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of regular bail, arises out of Daudnagar Police Station Case No. 263 of 2024, dated 02.06.2024, disclosing offences under Section 376, 511 of the Indian Penal Code and Section 8 and 12 of the POCSO Act.

3. As per the FIR, on 23.05.2024, in the night, the petitioner lured the informant's daughter, aged about 13 years, on the promise to give money and a mobile phone and tried to establish physical relationship with her. In the meanwhile, informant's wife woke up and saw that the petitioner was attempting to establish physical relationship with the minor

4. Learned counsel for the petitioner submits that petitioner is the relative of the landlord where the informant is a tenant. The petitioner had visited his relative's house and was sleeping in the room at night where the victim girl tried to steal his mobile phone and when she was caught, the present FIR has been lodged. The petitioner is in custody since 03.01.2025 and there is no likelihood that the petitioner will abscond or tamper with the evidence.

Regards being had to the submissions made by the parties and taking into consideration the fact that the petitioner is in custody for the last six months, charge sheet has been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, accordingly, I am inclined to grant regular bail to the petitioner.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Additional District and Sessions Judge VI Cum-Special Exclusive Judge (POCSO), Aurangabad, in connection to the Daudnagar Police Station Case No. 263 of 2024, dated

8. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
