The sole petitioner, who is in custody in connection with Balrampur P.S. Case No. 112 of 2014 registered for the offence under section 307 and other a sections of the Indian Penal Code, has prayed for grant of bail.

Learned counsel for the petitioner has asserted that other two accused persons having similar accusation have already been granted bail by this court on 22.7.2015 vide Cr. Misc. No. 21733 of 2015. He submits that though it was alleged that petitioner used knife, there is no injury report on record. Keeping in view the fact that two accused persons almost in similar circumstances have already been extended the

Patna High Court Cr.Misc. No.26728 of 2016 (2) dt.11-07-2016 2/2 privilege of bail, there is no reason to refuse the same prayer to the petitioner.

Accordingly, let the petitioner namely Sanowar be enlarged on bail on furnishing bail bond of Rs. 10,000 /- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Sri B.K. Sharma, Judicial Magistrate 1st Class, Katihar/ concerned court in connection with Balarampur P.S. Case No. 112 of 2014.
