This application for grant of anticipatory bail arises out of Uphara P.S. Case No 12 of 2012, disclosing offence under Section 394 of the Indian Penal Code.
Keeping in view the nature of allegation and the fact that the petitioner's name transpired in course of investigation on the basis of confessional statement of co-accused, and that custodial interrogation of the petitioner might be required, I, am not inclined to grant the privilege of anticipatory bail to the petitioner.
Accordingly, this application for anticipatory bail is, hereby, rejected.
Patna High Court Cr.Misc. No.32347 of 2015 (2) dt.14-08-2015 2/2 The petitioner is directed to surrender before the court below within six weeks and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
