JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This is an application for grant of anticipatory bail in connection with Ramgarh (Nuab) P.S. Case No. 317 of 2018, disclosing offences under Sections 366(A)/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the minor daughter of the informant.

Submission of learned counsel for the petitioner is that the statement of girl has been recorded under Section 164 Cr.P.C. and she has not supported the prosecution case, rather she stated that she had gone with her own sweet will and married with the petitioner and further report of the medical board shows that she is aged about 18 to 20 years and both these documents are annexed with the petition.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Kaimur at Bhabua, in connection with Ramgarh (Nuab) P.S. Case No. 317 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
