The contention on behalf of the petitioner is that due to serious ailment of his mother, he could not surrender before the court of the Sub divisional Judicial Magistrate (West), Muzaffarpur in connection with Trial no. 469/2012 arising out of Complaint Case No. 1288/2004 as directed by a coordinate bench of this court vide order dated 30.01.2013 passed in Cr. Misc. no. 50152/2012. Accordingly, this petition stands disposed of with direction to the petitioner to surrender before the concerned court within two weeks from today and if the petitioner does so, the concerned court shall proceed with the matter in the light of order dated 30.01.2013 passed in Cr. Misc. no. 50152/2012.
