The petitioner apprehends his arrest in a case under Section 307 and some other sections of the Indian Penal Code. The informant alleged that the accused persons had taken loan for performing Shradh ceremony but on demand they were evading payment on one pretext or the other. On 03.02.2015 the accused persons surrounded him and assaulted with Farsa and Garansi. The petitioner is alleged to have assaulted the informant with Farsa on his forehead.
It is submitted that the petitioner lodged Basantpur P.S. case No. 19/2015 on 03.02.2015 itself. The informant of the present case filed complaint petition on 10.02.2015 and after two weeks of the occurrence the present FIR was lodged. The
Patna High Court Cr.Misc. No.33515 of 2015 (3) dt.15-10-2015 2/2 petitioner is alleged to have assaulted Sanjay Singh with Farsa but the doctor issued injury report at page 19 showing that the informant did not get any injury. Dr. Ravi Ranjan found partially healed wound on the head opined to be simple in nature. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Basantpur P.S. Case No. 43 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
