The petitioner seeks bail in Forbesganj P.S. Case No. 79/2018, instituted for the offences under Sections 302 and 34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is not named in the written report. There is no recovery of any incriminating article from his possession. It is submitted that the police recorded confessional statement of the petitioner in the instant case as mentioned in para 32 of case diary, which is mentioned in the impugned order. It is further submitted that police had arrested this petitioner in Forbesganj P.S. Case No. 89/2018 and in that case, the police had recorded confessional
Patna High Court Cr.Misc. No.55125 of 2018 (3) dt.04-10-2018 2/2 statement of petitioner and on the basis of aforesaid confessional statement, petitioner has been made accused in this case. Petitioner is in custody since 22.02.2018.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 79/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
