Petitioner is an accused in connection with Desari P.S. Case No. 298 of 2019 for the offence registered under Sections 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant case. In fact, the co-accused having more or less similar allegation has already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 86190 of 2019 vide order dated 31.01.2020 and the case of this petitioner stands on similar footing. The petitioner is rotting in custody since 08.12.2019. Considering the facts and circumstances of the case, the petitioner is directed to be enlarged on bail in connection

Patna High Court CR. MISC. No.17357 of 2020(2) dt.10-06-2020 2/2 with Desari P.S. Case No. 298 of 2019 to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur subject to conditions as imposed in the order dated 31.01.2020 passed in Cr. Misc. No. 86190 of 2019 which is quoted hereunder; "... to deposit a cash of Rs. 1,00,000/- (One Lakh) in the court below and on deposit of the same, the Court below shall release the petitioner, above named, on bail on furnishing bail bond of Rs. 1,00,000/- (One Lakh) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Desari P.S. Case No. 298 of 2019. However, it is made clear that the petitioner shall extend full cooperation for early disposal of the trial. In the event the petitioner fails to appear for two consecutive dates in the court below without any cogent reason, the court below shall be at liberty to cancel his bail.

The cash deposit of Rs. 1,00,000/- (One Lakh) shall abide by the final outcome of the pending criminal case."
