JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

The prosecution case is that one empty gas-cylinder was recovered from the shop of the petitioner when it is alleged that the domestic gas-cylinder is used for commercial purposes. It is submitted by learned counsel for the petitioner that the petitioner has no criminal antecedent, a statement to that effect has been made in paragraph 3 of the petition. Considering the nature of recovery and the petitioner having no criminal antecedent, let him be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail

Patna High Court Cr.Misc. No.33098 of 2015 (2) dt.12-08-2015 2/2 bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No.189 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
