The petitioner seeks bail in a case registered under Sections 394 of the Indian Penal Code.

It is contended that the petitioner has not been named in the first information report. It is further contended on behalf of the petitioner that he was taken in custody in connection with Motihari Town P.S. Case No.198 of 2016 registered under Section 414 of the I.P.C. and 25(1-B), a, 26 of the Arms Act in which he has already been granted bail. Allegedly, on the basis of his selfincriminating confessional statement made in the aforesaid case he has been made accused in Motihari Town P.S. Case No.169 of

Patna High Court Cr.Misc. No.26616 of 2016 (2) dt.14-07-2016 2 / 2 2016 as well as Motihari Town P.S. Case No.193 of 2016. It is contended that except this alleged self-incriminating confessional statement there is nothing against the petitioner and there is no recovery from him. He has been remanded in this case on 30.03.2016.

Having regard to the facts and the circumstances of the case, the petitioner, Samsad Alam @ Samshad Alam is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Town P.S. Case No.169 of 2016.
