Earlier the prayer for bail of the petitioners was disposed of with direction to the learned trial court that once the charge is submitted, he will verify from the diary as to whether there is specific allegation against the petitioners or not and if he is satisfied that thee is no specific allegation against them, he will release the petitioners on bail, however, it appears that the learned court below has rejected their prayer for bail on the ground that they were torturing the deceased prior to the occurrence and the dead body was found near the village, as such there is suspicion against them, apart from that no incriminating circumstances have come against them.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.55799 of 2017 (3) dt.13-12-2017 2/2 Having heard both sides and in view of the fact that they are lady, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Siwan Muffasil P.S.Case No.16 of 2017, with condition that they will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise their bail bond shall be cancelled.
