In the present writ application, the petitioner has prayed for quashing of the order dated 15.03.2018 passed by the Respondent No.2 i.e. District Magistrate, Khagaria in Arms License Record No.16 of 2018, whereby and whereunder the application of grant of arms license has been rejected. The petitioner has challenged the order dated 15.03.2018 passed by the Respondent No.2. The ground of rejection of the application made by the petitioner for grant of license is that there is no threat perception to the petitioner. The

Patna High Court CWJC No.6744 of 2019(2) dt.04-04-2019 2/2 petitioner has further relied upon a case reported in the case of Manish Kumar vs. The State of Bihar through the Commissioner, Patna Division & ors. [2015(4) PLJR 212]. Considering the reliefs sought for in the present writ application, the petitioner is directed to prefer an appeal under Section 18(1) of the Arms Act, 1959 within a period of 30 days from today. The appellate authority shall consider the grievance of the petitioner and pass an appropriate order in accordance with law taking into account the judgment as referred above in this case and pass final order within a period of five months from the date of filing of such appeal.

With the aforesaid observation and direction, the present writ application stands disposed of.
