JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2018.

Prosecution case is that 90 liters of illicit liquor was recovered from the hut.

Learned counsel appearing for the petitioner submits that the recovery has been made from the hut which does not belong to the petitioner. The name of the petitioner has surfaced only on suspicion.

Learned counsel for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner,

Patna High Court CR. MISC. No.20223 of 2023(2) dt.15-05-2023 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. II Ara at Bhojpur in connection with Udwantnagar Police Station Case No. 533 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
