JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

It is alleged by the Manger of Tirupati Transport that he got loaded Wheel detergent powder on a truck worth Rs.3 lacs and the consignment was to reach Madhubani but the same went missing. Hence, it is alleged that the owner and driver of the truck misappropriated the goods.

It is submitted by learned counsel for the petitioner that petitioner is owner of the truck and the petitioner has also lodged Hajipur Sadar P.S. Case No.586 of 2015 against the driver of the truck when his truck went missing.

Considering the thrust of accusation against the driver

Patna High Court Cr.Misc. No.32455 of 2015 (2) dt.10-08-2015 2/2 of the truck and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let he be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hajipur at Vaishali in connection with Hajipur Industrial Area P.S. Case No.187 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
