The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, three named accused persons robbed the informant, a Manager in the private finance company of his belongings including the cash that he was carrying.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against three unknown. The name of the petitioner transpired in course of investigation wherein he was identified in a CCTV footage by the local people and the spy. However, it is further stated that from perusal of the

No.29035 of 2021(3) dt.07-01-2022 2/2 relevant paragraphs of the case diary it would transpire that it has not been stated in the case diary that the petitioner is seen committing the occurrence. The petitioner has not been put on T.I. Parade inspite of being in custody since 14.1.2021, he has no criminal antecedent and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has transpired in course of investigation and the petitioner having remained in custody for over 11 months, the Court directs the petitioner to be enlarged on bail in connection with Mufassil P.S. Case no. 213 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st , Katihar.
