Petitioner seeks bail in a case registered under section 302/34 of the Indian Penal Code.

Petitioner is named in the first information report and it is alleged that he as well as co- accused Pankaj Kumar assaulted the informant's husband by means of katta as a result whereof informant's husband died in course of his treatment. Submission on behalf of the petitioner is that informant does not appear to be an eye-witness of the alleged occurrence and, as a matter of fact, some unknown person committed the murder of the deceased but informant lodged this case against the petitioner and others on account of village politics.

Regard being had to the facts and circumstances as well as submissions of the parties, I do not feel it proper to release the

Patna High Court Cr.Misc. No.29249 of 2016 (3) dt.03-10-2016 petitioner on bail and hence, his prayer for in connection with Sheikhpura (Hathiyawan) P.S. Case no. 300/2012 pending in the court of the Chief Judicial Magistrate, Sheikhpura stands rejected. However, Chief Judicial Magistrate, Sheikhpura/ concerned court should commit the case of the petitioner to the court of sessions in accordance with law as early as possible.
