The petitioners are languishing in custody since 12.12.2018 in a case registered for the offences punishable under Sections 461 and 379 of the I.P.C.

The prosecution case as per the written report of Manoj Mandal submitted to the SHO, Bheja Police Station is to the effect that from the shop of the informant, several mobile phones were stolen, leading to the registration of FIR against unknown persons. It is further alleged that during course of investigation, co-accused Pawan Mukhiya was apprehended, who disclosed the name of the petitioners and from their houses, certain mobile phones were recovered.

No.19408 of 2019(2) dt.02-04-2019 2/2 It is submitted by learned counsel for the petitioners that investigation has already been concluded and the petitioner has not been put on T.I. Parade till date. A statement has been made in paragraph no.3 of the petition that the petitioners are involved in one other case.

Learned APP submits that recovery has been made from the conscious physical possession of the petitioners. Considering the fact that investigation has already been concluded and petitioner has not been put on T.I. Parade till date, let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-III, Jhanjharpur, Madhubani in connection with Bheja P.S. Case No.07 of 2018.
