The petitioner seeks regular bail in connection with Ada Pur P.S. Case No. 242 of 2017 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition Excise Act, 2016.
The allegation is regarding recovery of 31.2 litres of Nepali wine which was being carried by the petitioner. Upon seeing the Police, the petitioner tried to flee away, however, he is said to have been arrested from the spot.
The learned counsel for the petitioner submits that no recovery has been effected from the person of the petitioner and he is said to be in custody since 26.08.2017.
Considering the nature of accusation and the period of
Patna High Court Cr.Misc. No.63370 of 2017 (2) dt.17-01-2018 2/2 custody already undergone, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Excise-7th-cum-Special Judge of Excise, Motihari, East Champaran in connection with Ada Pur P.S. Case No. 242 of 2017.
