The petitioners, namely, Suraj Sharma and Dhanji Sharma, apprehend their arrest in a case under Sections 363, 366, 366(A)/34 of the Indian Penal Code.
The informant, father of the victim, made allegation that Ashok Sharma and Ajay Sharma kidnapped his daughter. During the course of search, the informant came to know that Suraj Sharma, Dhanji Sharma (the petitioners) and Anil Sharma also helped Ajay Sharma and others in kidnapping his daughter. It appears that the informant is not an eye-witness of the occurrence. It is submitted that the victim was having love affairs with Ashok Sharma and she solemnized marriage with him. The petitioners have no manner of concern with the victim and Ashok Sharma.
Patna High Court Cr.Misc. No.36011 of 2015 (3) dt.03-11-2015 2/2 During the course of investigation, one of the witnesses came forward to say that the petitioners were not involved in kidnapping of the victim.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Anand Kumar Singh, Judicial Magistrate, 1st Class, Bhojpur, Ara in Sandesh P.S. Case No. 86/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
