Petitioner is in jail custody since 06.01.2020 in connection with POCSO Case No. 190 of 2019 arising out of Didarganj P.S. Case No. 277 of 2019 registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code as well as Sections 8/12 of POCSO Act. Although, petitioner is named in the first information report but no specific overt-act has been attributed against him and it is pertinent to note here that having more or less similar allegation, some co-accused have already been granted privilege of anticipatory bail by a co-ordinate Bench of this court vide
Patna High Court CR. MISC. No.20319 of 2020(5) dt.02-11-2020 2/2 order dated 21.01.2020 passed in Cr. Misc. No. 3892 of 2020. Moreover, it appears that there is case and counter case between the parties.
In course of hearing, learned counsel appearing for the petitioner points out that both parties have resolved their dispute outside the court and the aforesaid submission may be recorded. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Patna in connection with POCSO Case No. 190(A) of 2019 arising out of Didarganj P.S.
