JUSTICE RAVI RANJAN ORAL ORDER 15-07-2016 Heard learned counsel for the petitioner and the State. Petitioner seeks bail in a case registered for offences punishable under Sections 420, 106, 409, 467, 468 and 120B of the Indian Penal Code.

It is submitted on behalf of the petitioner that there is general and omnibus allegation against about 80 persons of different districts in the complaint petition which was sent to the police under section 156(3) of the Code of Criminal Procedure for institution of First Information Report and investigation. It is further submitted that so far the petitioner, who is accused no. 2 in the First Information Report, is concerned, there is no allegation of receiving money from anyone. It is not a case that some branch office of the alleged company was opened in Udakishunganj and

The complainant has not stated as to what amount was given to the company and how much money is still to be received back by him. It is urged that vague, general and omnibus allegation has been made against the petitioner. So far accused no. 1 is concerned, he happens to be the Managing Director of the company. The petitioner has categorically stated that he is not an employee of the company. He claims to be in custody since 06.04.2016.

Having regard to the facts and circumstances of the case, the petitioner, namely, Md. Mehtab Alam @ Mahtab Alom, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Udakishunganj, Madhepura in Udakishunganj P.S. Case No. 166/2015.
