This is an application for bail in connection with Chapra Rail P.S.Case No. 86 of 2017 registered for the offences punishable under Sections 392, 394 and 411 of the Indian Penal Code.
Petitioner is not named in the FIR and it appears that on the basis of confessional statement of co-accused some articles have been recovered from his possession.
Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he has falsely been implicated in this case only because he is accused in two other cases and he is in custody for two months. Heard learned APP also.
Patna High Court Cr.Misc. No.56322 of 2017 (2) dt.23-11-2017 2/2 Having heard both sides and considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner.
However, once charge has been framed against the petitioner in this case, learned trial court shall release the petitioner on bail to its own satisfaction with an undertaking that he will co-operate in trial and appear in court on each and every date, otherwise his bail bond shall be cancelled. With the above observation, this application is disposed of.
