JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Lalganj P.S. Case No.115/2018 for the offence registered under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code. The petitioner is husband of the informant. From the fardbeyan, it appears that the petitioner along with other family members entered the house and assaulted the informant. Learned counsel for the petitioner submits that the petitioner is the husband of informant. He has not inflicted any injury. Offence was committed in presence of the husband and the reason is family dispute. The petitioner is in custody since 28.05.2018.

Considering the fact that the petitioner is husband of

No.54430 of 2018 (2) dt.20-09-2018 2/2 the informant and the learned counsel for the petitioner submits that the petitioner is ready to keep his wife with full honour and dignity, let the petitioner named above be released on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur, in connection with Lalganj P.S. Case No.115/2018.

The petitioner is obliged to file an undertaking before the court below that he will keep his wife with full honour and dignity. The Court below will direct the petitioner to execute bond and after release the court below will assess the conduct of the petitioner fortnightly for a period of six months to ensure that the petitioner is honest in carrying the undertaking to keep his wife with full honour and dignity.

With the aforesaid condition, the instant application is disposed of.
